Immigration
to the United States of America has become a complex and confusing problem. In
order for a foreign national to enter the United States, the foreign national
must qualify for a visa. In addition to security and background checks, there
are limits on the length of stay and work authorization. Our office helps
foreign nationals obtain the best visa consistent with their entrance to the
United States.
Generally there are two types of visas to enter the
United States. A non-immigrant visa is for foreign nationals who want to visit
or maintain a temporary residence in the United States. An immigrant visa
(Green card) is for foreign nationals who want to maintain a permanent
residence in the United States.
At our office, we work with you and
provide a specialized analysis to determine the best visa for your needs, based
upon your reasons for coming to the United States whether it is for business or
pleasure, short term or permanent. Attorney fees for immigration cases are
determined on a case by case basis depending on the type of visa.
A sample of the types of visas available is listed below. Please

NON IMMIGRANT VISAS
VISTOR VISAS: (B1, B2) Travel to the
United States for business purposes or to visit the United States as a tourist.
Purposes include, but are not limited to: negotiating contracts, attending
meetings, conferences and trade shows, purchasing goods, developing business
relationships for importing and exporting goods, visiting family and friends,
seeing Disney theme parks, obtaining medical treatment.
STUDENT VISAS: (F1) Students may use the F1 visa category in order to
pursue academic studies and/or a language training program. F-1 visas are given
for a variety of academic fields and programs. To be able to get a student
visa, a candidate needs to choose an institution or language school approved by
the US government.
EXCHANGE VISITORS: (J1) The exchange visitor program is
designed to facilitate educational and cultural exchange between the United
States and other countries. A variety of programs are available, please see our
J1 exchange program page for details.
FAMILY VISAS: (K1, K3) The fiancé
or spouse of a U.S. citizen and their children are allowed to enter the United
States to complete the green card
process.
EMPLOYMENT VISAS: (H, L, O, P, R) Temporary employment visas are
available for persons who are offered employment in a variety of
specialty occupations. Visas are available for intra company
transferees for persons who have managerial, executive, or specialized
experience. Other work visas exist for athletes, entertainers, artists, and
religious workers.
INVESTMENT VISAS: (E1, E2) Visas are
available for foreign nationals who wish to invest funds in the United States
of America.. E-1 "Treaty Traders" are persons engaging in substantial trade
between the U.S. and their home country. E-2 "Treaty Investors" are persons
coming to the U.S. to develop and direct enterprises in the U.S. in which they
are investing a substantial amount of capital.
OTHER VISAS: Other non immigrant visas may be available depending on
your individual needs.
IMMIGRANT VISAS
FAMILY: Green cards are available for
immediate relatives, brothers, sisters, parents and Diversity Lottery winners.
Immigrant visas are available to qualified relatives (spouses, children,
sisters, brothers, parents) and others who wish to live in the United States
permanently or indefinitely. All categories are numerically limited and annual
per-country limits and quotas are prescribed by law. This can create some
delay.
EMPLOYMENT: Green cards are also available for foreign nationals who
are skilled or educated and who have job offers have the possibility of
immigrating to the United States. Typically, the prospective employer must
first obtain a labor certification and approval of a petition. An approved
Labor Certification (LC) is a document issued by the U.S. Department of Labor
(DOL) certifying that: (1) An employer needs the foreign worker's skills and
abilities; (2) The employer has tried to recruit U.S. workers for the position;
(3) The employer has offered the position at the normal or prevailing wage; and
(4) The employer has found no qualified workers.
INVESTMENT VISAS (EB-5): Green cards are available to immigrant
investors who invest capital, create jobs and stimulate the U.S. economy under
the EB-5 immigrant visa program. Programs are available for an investment of
$500,000 or $1,000,000. A $1,000,000 investment must be made in a new
commercial enterprise approved by the U.S. government. A $500,000 investment is
also possible if the investment is made in a targeted employment
area within the United States.
NATURALIZATION
After a permanent resident has resided
in the United States for 5 years (3 if they are married to a U.S. citizen), the
permanent resident is eligible to become a U.S. citizen.
